Yes, if you choose to terminate your agreement, your deposits will be refunded, plus interest in accordance with the Condominium Act. We will be seeking Court approval of the deposit return protocol - please note that this process may take a couple of months."

I thought the protocol was to get it back via Trisura and/or Tarion??

So I followed up with:
"I was under the impression that the protocol for returning the deposit would be through Trisura and/or Tarion, as outlined in the court proceeding that buyers were invited to.
Could you please clarify if this is still the case?"

And Meg replied:
"Yes, that is correct. KSV will be seeking Court approval of the deposit return protocol, but the insurers will be the ones to implement and manage that process."

Can someone please clarify why there's a need to return to court for a process that was already addressed in court and approved by the judge? I’m really confused because this had already been agreed upon.

More like:

"Hey judge, we couldn't convince people to agree to the new APS, so we need to refund their deposit. The deposit is split between insured and non insured, this is out plan/protocol we'll follow to return their deposit i.e. how we'll condinate the refund. Please approve it."

So it's an update to the judge/courth and approval of their plan/protocol.
