There are 5 more days for them to send amended APS (as they have to give us 30 days to review and make a decision). If we do not receive amendments this week, I predict they will cancel all existing APS. This is increasingly likely as the days progress toward the April 25 outside occupancy date.
 
I haven't received an amended APS either. All the same to me as I had no intention of accepting it at the new prices shared by others in this thread for similar units. Hoping for a smooth and swift termination of my agreement.
 
I haven't received my amended APS, 2017 buyer here...I don't think they would be able to send all the APS out today..lol..(today is the last day-30 days prior to closing date)..so I assume next month all APS are considered cancelled...

Was it supposed to be your primary residence or for rent? Wondering if they sent to those that bought it as their primary residence to see if they'll accept the new APS. For investors, they know most of them might not be able to close with revised APS considering the current interest rate environment. So it make sense to cancel those.

I haven’t received APS yet. It is for primary residence. I’ll wait for today and email them tomorrow for update on termination

Back in 2017 I bought it as my primary residence..I soon realized that they are not going to complete it on time..so it became my investment property as I moved to Cambrridge and bought few properties here...

Wow, then my theory doesn't make sense. It seems there's no logical approach to why some received revise APS, while others didn't. I remember you also bought in 2017/18 right?

Reasonable. But I don't think they know it's not designated as an investment property. Either ways, there's no logical way to determine why some buyers from 2017/18 haven't received revised APS.

All parties involved have been through an ordeal with Vandyk. KSV and the court process should also consider making good on orders and instructions/info shared with purchasers. The continuous disappointment and anticipation is unreal. First, it was constantly walking or driving by the site for years to see construction progress and anxiously awaiting next steps from Vandyk. With KSV, it's been a painstaking and manic process of checking email, junk folders, deleted folders, letter mailbox, voice messages and this thread for any word on this mystical amended APS that is expected and yet to appear.

I agree with you. I remember the last court day where KSV clearly stated that buyers will receive the revised APS in batches as soon as possible, in the coming weeks. This was in Oct 2024.
 
This is beyond frustrating but hopefully we hear from them by EOD today - technically today will be the last day to ensure we have 30 days to consider their amendments (how beneficial for them with the 31st of March giving them an extra day). I don’t understand what the delay could be and honestly the lack of action until the very last moment clearly exemplifies how they plan on executing any future actions and developments… sigh… what an epic disappointment…
I just want to close this unfortunate chapter… hoping for the best today friends! Keep an eye on your inboxes!
 
APS Update:

I signed in December 2018 and still haven’t received an APS.

I spoke with KSV on the phone earlier today and was told that quite a few APS are still left to be sent out, but they are expected to be issued by the outside occupancy date. Once we receive them, we’ll have 30 days to respond. If we don’t receive anything by the outside occupancy date (which for me is in April) we have the option to terminate the contract (within 30 days) under what I believe is called the purchaser’s termination period (I found this in one of the original contracts).

I also asked about deposit returns and was told it would likely take a few months (i was curious if it's thats something that would drag on for years or something likely to be resolved in weeks)
