Just got the email with 3 attachments an hour ago. Price increase of $288,010. 3 bedroom Haven new price $903k closing date September 1, 2027

I believe those who are refusing should also push for some sort of involvement when this goes back to the court for the return of the deposits. It’s been a long 7 years and I don’t think anyone here wants to wait another x amount of months or years to get their money back. Just a thought.

“You are encouraged to seek legal advice with respect to these matters.”

Do we need a lawyer to get our deposits back?
Don't think so. Probably just a generic statement implying they are not providing legal advice of any kind, and that we should do our own due diligence with a real estate lawyer in regards to our decision.

I feel like 90% of purchaser rejected the amendment. I am not sure, if this forum is biased towards rejection :). But I know around 4 purchaser outside of this forum, they all rejected. I felt like most of the people in this forum also rejected the amendments.

If that's the case how could they complete the project before September 2027, without any purchaser? I dont think that they could sell all the rejected units within 2 years in current market with this over inflated price.

I know of only one acceptance. All my contacts rejected including me. It just doesn't translate financially to me. While I'm a FH buyer, I'll rather buy resale at this point!

Anyone know how long it took some of the other Vandyk developments to get their money back? I’m just hoping it’s soon.

Good question, has anyone in this group receive refund, also would they give principal + some interest on our money after 7 year?

I just received my APS but I previously asked KSV about interest and they advised that our deposits would be returned plus interest.

Interest on deposits is regulated, and applies whether you go through with the purchase or not. For purchases before 2023 (nearly everyone in this forum bought before regulations changed) it's the Overnight Bank Rate - 2% with a floor of 0%. You can ignore 2017 through 2022 for your calculations (interest earned is $0); from 2022 through today there's roughly a total $7k interest per $100k deposit.

If you signed the new APS you should be getting straight Overnight Bank Rate (as per 2023 legislation) from the signature date onward.
