I received the below response to my email:

Thank you for your email. The amendments are being sent in batches to facilitate an orderly process where we can have sufficient resources dedicated to meeting with purchasers (if required) and responding to all inquiries in respect of the same. We will send your letter as soon as your batch is ready to go out. After receiving your letter, you will have an opportunity to have an in-person meeting to discuss.

If you choose to terminate your agreement, we will be in touch in due course with the instructions for deposit return, once they have been approved by the Court. Please note that this process may take a couple of months. Interest calculated in accordance with the Condominium Act will be included on the deposit return.

We expect to send all APS amendments out by the end of April. Your letter will be sent as soon as your batch is ready to go out.
 
Absolute bullshit that April 25th ultimately means nothing. Who's to say they can't extend it even further if they wanted to?

Elevate Condos in Kitchener is also under KSV receivership, and they were sent their Deposit Return Protocol. No clue why KSV is dragging ass on this non-viable project and not just selling it and cutting us loose.

So what happens when we officially reach the Purchaser's Termination Period (Mine says May 26, 2025)???

I copied and pasted this from the last amended APS from Vandyk:

3. Purchaser’s Termination Period If the home is not complete by the Outside Occupancy Date, then the Purchaser can terminate the transaction during a period of 30 days thereafter (the“Purchaser’s Termination Period”), which period, unless extended by mutual agreement, will end on: If the Purchaser terminates the transaction during the Purchaser’s Termination Period, then the Purchaser is entitled to delayed occupancy compensation and to a full refund of all monies paid plus interest (see sections 7, 10 and 11 of theAddendum).

Do you think KSV is really gonna pay us interest??? Technically, that's what the APS says...They can't pick and choose which aspects of the APS are valid.

They confirmed to me in an email that we are entitled to our deposit return plus applicable interest per the Condominium Act if we choose to terminate our contract. Deposit return process will happen post another court session.

Same. My outside occupancy date is April 25, 2025...and my Purchaser's Termination Period is May 26, 2025...

That's great news. I'm going to email Meg, so I can get that in writting too!
 
I expect the above to take place with Uptowns PHASE 1 as well. Since they haven't sent any of the "other batches" of Amended APS' and we near April 25th 2025.
 
Outside occupancy is April 25, 2025; contract cancellations are far more likely. Purchaser contracts expire at the end of April; then we have 30 days for buyer termination in the original contracts. They will likely assess the total acceptance rate of new APS' and determine if existing contracts will be canceled. Let's see though.
