“During Monday’s sentencing hearing, Crown prosecutor Shivani Naidu-Barrett noted Wheeler’s lengthy criminal record, which includes a half-dozen convictions for carrying concealed weapons and three other random attacks on transit users. They include a robbery with an axe for which he received 14 months, as well as a 2016 incident in which he punched a man at the Belvedere station, causing him to fall onto the tracks.

Wheeler was also convicted for spraying three strangers with bear spray at Millgate transit centre in 2016.

Defence lawyer Tariq Salloum sought a shorter sentence, in part due to his client’s fetal alcohol spectrum disorder (FASD) and Gladue factors related to his Métis heritage.”

This is why people are losing hope and increasingly becoming more extreme in theirs views. What a joke of a legal system.

Failed the family by not getting this guy in prison for longer for numerous other sentences. And now a joke of a 7 year sentence thanks to Gladue factors….

Screw the judge and defense. Blood on their hands.

It’s getting to the point now where justice reform is one of my top election issues. I don’t care who fixes it but it needs to be fixed. Enough is enough. Our communities are demonstrably less safe with these laws and gladue reports/get out of jail free cards.

How are Judges held accountable? Do Judges in Canada have performance reviews and if so who does them? After time served Wheeler should be out in 4-5 years and when he commits another crime will the Judge and Prosector be held accountable? Its a joke. Hard to believe how many Canadians are willing to accept this nonsense because they thought Trump was going to invade Canada. In a democracy the people deserve the government they get - its no surprise these types of rulings because they have been going on for years.

The Conservatives and PP talked about crime and safety throughout the last federal election - this is a federal issue. However, Trump duped so many Canadians who believed all his 51st state nonsense and the "Elbows Up" Liberals were reelected. If ever a government deserved to lose an election it was this group of Liberals but they somehow won again - and all Canadians are paying for it. "Elbows Up" everybody.

The ruling in the Jamal Wheeler case is shocking on many levels. The victim was random attacked and stabbed to death while waiting for an LRT train - how horrifying for this person and must have been extremely painful and shocking and a terrible way to die. How horrible for his family and friends - what about his rights? The Judge and Prosecutor should be ashamed of this outcome but I'm sure they aren't because they justify it through a racial lens. I believe Canada used to be a mostly tolerant, safe and just society - however it is increasingly a institutionalized racist society where there are different laws for people depending on their race and background. If Jamal Wheeler had not been indigenous what would the sentence be? Can non-indigenous people with unfortunate backgrounds get the same treatment? Also, should having an unfortunate background allow people to walk up behind someone and stab them to death and only serve 7 years in prison? What has happened to the rights of law abiding people who work hard, try to be good productive citizens and respect the laws of this country and where are the laws protecting them and keeping repeat violent offenders like Wheeler in prison where they belong. Its very disturbing and I can't believe so many Canadians are apparently okay with the status quo. The laws should not pick favourites - obviously indigenous people have been treated badly in the past in Canada, and even today examples like the Pacey Dumas case are horrible - the police officer who assaulted Dumas should have been charged with attempted murder and again the prosecution did not do their job. However, indigenous, or anyone for that matter, who commits heinous crimes against their fellow citizens needs to be punished appropriately.

From Jamie Sarkonak in the National Post: Akashkumar Khant, an engineer from India, tried to buy sex from what he thought was a 15-year-old in Mississauga. He was given a conditional discharge (no crim record), in part because the judge didn't want to disrupt his immigration prospects. Khant was charged with soliciting sex from a minor, but he pleaded to the lesser offence of indecent act. That, combined with his/his wife's immigration status and the judge's positive assessment of his rehabilitation potential, all helped him out here. We should have zero tolerance for outsiders who do stuff like this. Our priority should be Canadian minors, not the men who would victimize them. Also, it's unfair to punish actual Canadians more harshly for the same crime.

It's amazing that judges using the Federal Liberals polices, and catch and release laws, are able to do things like this with no accountability. Canada since 2015 under the Liberals has sunk to new depths - still amazed they won the last election over the Conservartives. I guess many Canadians truly believed that Trump was going to mobilize the USA marines and invade Canada and make us a state. Its hard to believe any halfwit would actually believe this but millions did - and the country is paying for this electoral decision. Seems like Canada is more European like Carney claims - this case reminds me of the horrible things happening in the UK with the rape gangs. Elbows up everyone!!

Good on the cops for the sting operation, but wow what an idiotic resolution from the judge. The common law precedent this sets is grim.

Wrong.
Provinces have absolute control over public safety, and the provincial courts are also the ones bearing the largest part of the burden, not federal courts, so this is, in essence a provincial issue and, guess what, at least in Alberta, which is what we're discussing here, it's the conservatives fault. Go back one case and try again.

I'll take being more European over being more American any time of the week, and being more American-like, even if not a 51st state, is what we would have gotten had PP and the conservatives won the election, and we'd be paying dearly. If you want an example of what a PP-led conservative government would be, just look at Danielle Smith's provincial government and the absolute hellscape she's turning this province into. The far-right, populist and bigot conservative movement we have nowadays is too far gone, and a far cry from the moderate, fiscally conservative and grounded PCs of old.

If you really think a Conservative victory would have led to Canada suddenly becoming more American and "far right" and PP is a "fascist" and blah blah blah. The Liberals have been arguably the worst government in Canadian history, and you can see it everyday on the streets, in the media reports, in the courts. So many problems with the economy, immigration, cost of living and so so many scandals. This country needed a change of government, but people like you who focus on anti-Americanism and the fear of the "far right' invaders led by an obnoxious President decided to brush aside all the Liberal mismanagement. Its incredible - like I said before, Canadians deserve the government they get and they are as you say "paying dearly". Canada is becoming a joke of a nation, mostly by self destructive policies and its global reputation has never been lower - and this was achieved by the Liberals, not Trump or PP or Premier Smith. By almost every socio-economic metric the Liberals have failed - but people like you will still vote for them. Liberals forever!! Eternal governors of Canada!! Elbows Up!!

Wrong.
The federal government, through Parliament, makes laws that affect all of Canada.
Examples of federal jurisdiction include:
  • Criminal law
