I live near Bazis EmeraldPark - where Bazis filled tree-well with cheap quality soil - construction sand more likely, the irrigation never worked,... as a result their planted trees dies after 1 years, we bitch for a year and they gets replaced,... first planted in 2015 when EmeraldPark construction was finishing up and getting occupancy, many replaced again in 2017, and then many replaced again in 2019,.... replaced every 2 years,.. but not 2021? Trees are still dying,... heck, dead trees left so long the bark started falling and I was tempted to cut a few branches to shape the dead skeleton trees into Coat Racks - oh, I just love embarrassing CityStaff into doing their job! And I know it's hard for some of you to believe,... but I tend to complain once in a while! And after a lot of complaints (from myself, other neighbours and our local Ratepayers Association),... these trees weren't replaced until late 2022,... why? Why did it take longer this time?

hmmm,... while the dead/dying trees are technically on City's Right-Of-Way property and thus as Property Owner - and it's ultimately the City's responsibility,... these trees actually have a 5-year Guarantee Backed By Deposit Money
- While the Developer are responsible for constructing the in-ground tree wells, filling it with soil, installing irrigation, planting tree,.... they also left a Deposit
- IF any of the above are proven sub-par within 5 years,... including dead/dying tree that needs to be replaced,... it comes out of the Developer's Deposit money!
- Any money left in the Deposit after 5 years, is returned to the Developer

So in Bazis EmeraldPark case,... their streetscape trees first planted in 2015,.... then most replaced in 2017, and again most replaced in 2019 - this was done by the City financed by the Developer's Deposit money,.... then after 5 years, Developer got what remains of their Deposit money back. And when the trees stared to need replacement again by 2021, there's no Deposit money anymore to finance it,... now the City has to pay for it, so City stalls,... in late 2022, most trees were replaced AND their in-ground tree wells were dug out to replace all the cheap soil/construction sand with top quality soil! And this time, it's the City that pays for it!

Digging back in this thread,... it seems maybe we might have just missed that 5 year mark by a few months,.... but somebody needs to complain and also contact the local City Councillor to figure out the dates of the 5 year Deposit here! And If it's still valid,... have the City Councillor ensure it's billed to the Developer's Deposit money!!!
